Terms of Use

These Terms of Use ("Terms") are a legally binding agreement between you and 8TWELVE MORTGAGE US INC. ("8Twelve," "we," "us," or "our"), NMLS #2797296, a licensed mortgage brokerage, governing your access to and use of our website, applications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years of age and a U.S. resident with the legal capacity to enter into a binding contract to use the Services. The Services are intended only for use in jurisdictions where 8Twelve is licensed to operate.
2. Not a Lender; No Commitment to Lend
8Twelve is a licensed mortgage brokerage. We arrange but do not make loans. Nothing on this website constitutes a commitment, offer, or approval to lend, an interest rate lock, or a guarantee of any loan terms. All loan applications are subject to credit approval, property appraisal, income and asset verification, title review, and the underwriting guidelines of the applicable wholesale lender.
3. No Financial, Legal, or Tax Advice
The information on this website, including rate displays, calculators, articles, and other educational content, is provided for general informational purposes only and does not constitute financial, legal, tax, or accounting advice. You should consult your own qualified advisors before making any financial decision.
4. Rates, Payments, and Calculator Disclaimers
Interest rates, APRs, payment estimates, and other figures displayed on the Services are illustrative only, based on assumptions that may not apply to your situation, and subject to change without notice. Actual rates and payments depend on credit score, loan-to-value, property type, occupancy, loan program, lender pricing, and market conditions at the time of rate lock. Property taxes, homeowners insurance, mortgage insurance, HOA dues, and other items may apply and are not included unless expressly stated.
5. Equal Credit Opportunity & Fair Housing
8Twelve is an Equal Housing Opportunity broker. We comply with the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act and do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), receipt of income from any public assistance program, or the good-faith exercise of any right under the Consumer Credit Protection Act.
6. Electronic Communications and E-Sign Consent
By creating an account or submitting an application, you consent to receive communications and disclosures electronically, including those required by the Electronic Signatures in Global and National Commerce Act (E-SIGN), and to use electronic signatures during the loan process. You may withdraw consent as described in our E-Sign Consent Disclosure, but doing so may prevent us from providing the Services.
7. TCPA and Communications Consent
By providing your phone number, you consent to receive calls and SMS messages (including autodialed and prerecorded messages) from 8Twelve and our service providers at the number you provide, regardless of whether the number is on any do-not-call list. Consent is not a condition of obtaining a loan. Message and data rates may apply. Reply STOP to opt out of text messages.
8. Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information.
- Use the Services on behalf of another person without authorization.
- Reverse engineer, scrape, or interfere with the Services or attempt to gain unauthorized access.
- Use the Services in violation of any applicable law, including federal mortgage, consumer protection, anti-money-laundering, and OFAC sanctions laws.
9. Intellectual Property
All content, trademarks, logos, and software on the Services are owned by or licensed to 8Twelve and are protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
10. Third-Party Links and Services
The Services may contain links to third-party websites or services. We do not control and are not responsible for the content, accuracy, or practices of any third party. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, 8TWELVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 8TWELVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless 8Twelve and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual action in small-claims court. YOU AND 8TWELVE WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to the address below.
15. Changes to These Terms
We may modify these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
